MUAR, MALAYSIA: A 19-year-old housewife, who is six months pregnant, will have to deliver her first-born in prison. Rejecting an application to have the baby delivered at home, High Court Judicial Commissioner Datuk Ahmadi Asnawi said there was no special ground to extend such a privilege to the accused, M. Kristina.
He made the order after hearing submissions from the defence and prosecution at the High Court here today.
K.M. Manian, who represents Kristina, had applied to the court to grant bail to Kristina to enable her to give birth at home.
He said the accused also needed a balanced diet and quality food to enable her to breast-feed the child.
Deputy public prosecutor Haslinda Abu Bakar objected, saying that there were adequate facilities in hospital for the birth of the child.
She said there was no special ground to grant the application.
Manian later told reporters outside the court that he would filing an appeal to the Court of Appeal.
Kristina and her husband S. Sinnathurai were jointly charged at the High Court here on Monday with causing the death of B. Khosla Devi and her three-year-old daughter S.S.P. Keerthisa at Jalan Kebun Sayur, Batu 6 Jalan Mersing, Kluang, at 11.15pm on Nov 2, 2007.
Kristina and Sinnathurai, who found the bodies burnt in a car, were arrested when they lodged a police report in Kluang the next day.
