Uncle jailed for sodomising boy

KLANG, MALAYSIA: It was to have been a joyous occasion during the Hari Raya celebrations five years ago for a then 12-year-old boy, but it turned into a nightmare when his uncle sexually attacked him.

The incident took place at the grandparent's house in Telok Pulai, Klang, during a family get-together.

The family members were busy preparing lemang in the kitchen when the uncle called the boy into the room and sodomised him.

A year earlier, during the school holidays, the uncle had enticed the boy to an act of gross indecency.

After the second incident, the boy told his parents what had happened. The family lodged a police report against the uncle.

These were details revealed in court during the trial of the boy's uncle who was charged with two counts of enticing and sodomising the boy.

Yesterday, the Sessions Court here found the accused, a 40-year-old lorry driver, guilty of both the charges and sentenced him to 11 years in jail.

Judge Noradidah Ahmad ordered the accused to serve three years for enticing and eight years for sodomising his nephew. Both the jail terms are to run consecutively from yesterday.

The accused was found guilty of committing the offences between 9am and 10am on Dec 5, 2002, and at 9pm on Feb 1, 2003.

He was found guilty after a trial which saw six prosecution and two defence witnesses testifying.

Counsel Salim Bashir pleaded for leniency as his client has to support three children aged 5, 8 and 14.

He said there was no evidence to show the victim was threatened during both the incidents.

Deputy public prosecutor Mohd Azar Irwan Md Arifin, however, pressed for a deterrent sentence as the victim had been traumatised by the incidents.

"The accused's actions were monstrous. He took advantage of an innocent child," he said.

Noradidah sentenced the man but granted Salim's application for a stay of execution pending appeal.

She raised the accused's bail from RM8,000 to RM16,000 in one surety.
