SHAH ALAM, MALAYSIA: The complainant in a rape case was given a final warning by the Sessions Court to show up for hearing or have the case thrown out.
The 16-year-old schoolgirl, who was allegedly raped by her boyfriend, service centre operator Mohd Zaid Abd Latiff, 25, had failed to attend the hearing on four occasions. The court had issued an arrest warrant for her on July 14, the last hearing date.
Yesterday, the girl turned up and was given a stern warning by judge Azimah Omar.
When the judge asked her why she did not show up for the trial, she replied that her father was ill and that she did not have transportation from Rawang, where she lives.
She said her uncle, who was in the High Court for another case, had given her a lift.
Azimah replied: "You made the police report and the court must hear your testimony. If you are subpoenaed, you must be in court. If you don't come, I will have to throw out the case. This is the final adjournment in this case."
The girl was alleged to have been raped by Mohd Zaid in an apartment in Bukit Sentosa, Rawang, around 9.30am on April 9 last year.
Counsel Ariff Azami Hussain, appearing for Mohd Zaid, said his client and the girl were engaged in March.
Azimah then asked Mohd Zaid if he was going to marry the girl. He replied that he would marry her after she finished schooling.
"Then after you get married, we will see if the prosecution still wants to go ahead with the case.
"The assistant public prosecutor should check if she still wants to press charges against her future husband."
Azimah cancelled the arrest warrant and fixed March 9 to 11 next year for trial.
