No sex charges for 26, but narcotics dept to act

KUALA LUMPUR, MALAYSIA: Police will not pursue sex charges against the 26 people arrested during an alleged sex party on Thursday morning but the case will be referred to the narcotics department for further action.

The 26 included a 22-year-old newscaster at a private television network and a 24-year-old part-time actress who also is a scriptwriter.

When police stormed the 11th floor of the four-star hotel room in Jalan P. Ramlee here at 3.30am, all the people were still clothed and the few condoms that were found had not been used.

City CID chief Senior Asst Comm (II) Ku Chin Wah said that the case has been handed over to the city narcotics department for further action because of the drugs found.

City Narcotics chief Asst Comm Kang Chez Chiang said initial urine tests showed that nine people including the newscaster and actress had tested positive for drugs.

?The nine aged between 20 to 30 tested positive for ecstacy and ketamine and they will be sent to Kuala Lumpur Hospital for further tests,? he said.

Kang also said that all 26 of the detainees have been remanded until Jan 4 and are having their statements recorded.

?We are questioning them to identify the source of the drugs to aid further investigations,? he said.

He added the person found to have supplied the drugs could be charged under Section 12(2) of the Dangerous Drugs Act 1952 for possession.

Magistrate Amalia Marsita Hamdan issued the remand order for the 26 to enable police to investigate the case under Section 15 (1) (a) of the Dangerous Drugs Act as well as Section 39A (1) of the same Act.

Section 15 (1) (a) covers any person who consumes or administers to himself any dangerous drugs. If convicted, the person could be fined a maximum of RM5,000 or jailed for up to two years.

Section 39A (1) deals with an increased penalty covering the proscribed amount of certain dangerous drugs, punishable with a jail term of up to five years and a maximum of nine strokes of the rotan.

A check on court documents Friday showed that the 26 had been remanded on the same day they were picked up at the hotel.
