Any recourse in retail claim?
Wed, Jul 01, 2009
my paper

MY WIFE and I got into a dispute with a retailer who filed for bankruptcy recently. The bedroom set we purchased from her was never delivered.

We filed a claim at the Small Claims Tribunal and thereafter with the Insolvency and Public Trustee's Office (IPTO), but was told we will not be compensated if there are significant changes to the retailer's income.

We would like to know if there are other channels we can use to pursue this matter, as we understand we cannot take legal action against an undischarged bankrupt.

We feel very cheated and distressed as we are not getting positive feedback from IPTO.
